Building Surveys and Due Diligence

If you are acquiring an interest in a property, be it purchasing for your own occupation, as an investment or taking a lease on a commercial building – then you need to know what the condition of the property is like and whether you have any repairing obligations to adhere to.
Our thorough understanding of building design and construction enables us to carry out a pre-acquisition inspection or building survey; provide you with the appropriate advice on the nature of the building that you are proposing to occupy or own and any defects that are readily apparent and their remedial solutions.

Reinstatement and Wants of Repair

Whether you own a commercial property as the Landlord or occupy one as a Tenant, at the end of the lease there may be dilapidations which are the Tenant’s obligation to repair the property and to hand it back to the Landlord in good condition. The extent of these repairing obligations varies from lease to lease and property to property.

We can inspect the building or premises and compile a Schedule of Reinstatement and Wants of Repair detailing the items of disrepair, which either can be remedied by carrying out the works or by way of offering monitory compensation.

Our background and experience allows us to negotiate on behalf of the Landlord to either ensure that repairs are carried out satisfactorily or an acceptable financial settlement can be obtained. If representing the Tenant, our experience will assist in resisting the Landlord’s requirements at the end of their lease especially when the Schedule served by the Landlord proves to be artificially onerous.

Planned Maintenance Programmes

We can compile a planned maintenance programme on the property scheduling all the actual and potential repairs required together with cost estimates for such repairs, set out in a programme over a term of years.
The benefit of such programmes is to ensure that Tenants are not in breach of the covenants in their lease, that repairs are carried out before costs escalate due to neglect, so that clients can plan and allow for the cost of the work within their business plans.
